I.- Introduction

These particular conditions of the online store operated by Federica Cui, hereinafter BM, are offered as information prior to the purchase process and complement the general terms and conditions that regulate the general use of the website accessible through https://federicacui.myshopify.com/.
The realization of any purchase through BM necessarily implies the acceptance of the general terms and conditions of access and use of Federica Cui's website, as well as of these particular terms and conditions, without objection or reservation of any kind.

III.- Order processing 

The orders will have to be processed by BM, where the user will be informed prior to the completion of each purchase of the exact amount of each of their orders, including the associated shipping costs.
Only persons of legal age will be able to process orders through BM. The User who makes use of BM guarantees that he/she is, as well as the veracity of all the registration data provided to BM. In any case, the User will be the only responsible for the false or inaccurate statements made and for the damages caused to BM or to third parties due to the information provided.

IV.-Product availability

BM shows the information of product references and available stocks of products. 
If for any reason it is not possible to supply any of the products included in an order, BM will contact the User as soon as possible to inform him/her of this circumstance and will proceed to reimburse the amount paid for it. If the order contains other items, BM will ask the customer whether or not he/she wants the order to be processed or whether he/she prefers to cancel it.
If the unavailability of the product affects the entire order, BM will refund the full amount paid for the order, including the shipping costs that would have been charged to the order.

V.- Guarantees offered

The products marketed have the following warranties.
In any case and, in the absence of proof to the contrary, the products shall be deemed to be in conformity with the contract provided that they meet all of the requirements set forth below, unless the circumstances of the case make any of them inapplicable:
  1. Conform to the description given by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
  2. Are suitable for the uses to which products of the same type are ordinarily destined.
  3. Are suitable for any special use required by the consumer and user when he has made it known to the seller at the time of conclusion of the contract, provided that the latter has admitted that the product is suitable for such use.
  4. They have the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.
  5. The non-conformity is reported within the product warranty period, which currently corresponds to 1 year from the date of purchase.
In the event of proven non-conformity of the product with the contract, BM will proceed, if necessary and as appropriate, to repair, replacement, price reduction or termination of the contract, which will be free of charge for the consumer and user.

VI.- Delivery time 

All our orders are delivered by a courier service, within approximately 5 working days from the time the goods leave our warehouse if the order is destined for the Iberian Peninsula. If the order is placed after 3:00 p.m. it will leave our warehouse the following day.
*During the sales period, orders can be processed and shipped within one week.

VIII.- User behavior

It is not permitted to use the Website for:
  • Fraudulent purposes, or related to crimes or unlawful activities of any kind
  • Send, use or reuse material that is unlawful, offensive, abusive, indecent, defamatory, obscene or threatening in any way, or that violates intellectual or industrial property rights, including copyrights and trademarks, or confidentiality, privacy or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising, chain letters, mass mailings or any other type of "spam".
  • Generate any kind of unnecessary inconvenience or annoyance

IX.- Access and conditions of use

Full access to the Web pages of the Web Site requires that you first register as a user, once you accept the General Terms and Conditions.
When you use the Web Site, you are responsible for maintaining the confidentiality of your account information and password, and for restricting access to your computer to prevent unauthorized use of your account.
BM reserves the right to deny any attempt to access the Website, terminate accounts, delete or modify content, or cancel orders in the event that you fail to comply with applicable law, these Terms and Conditions or any Special Conditions or other terms and conditions or policies.

X.- Right of withdrawal

The customer may cancel the order without giving any reason within 30 calendar days of receipt of the order. For the computation of this period shall be taken as a reference the date appearing on the receipt of the carrier signed by the customer. In the event that the expiration date of this 30-day period coincides with a Saturday, Sunday or holiday, the period will be extended until the next business day. The right of withdrawal shall be exercised by sending an email to the address info@federicacui.com through which you will indicate your intention to return the order. The exercise by the consumer and/or user of the right of withdrawal entails the automatic termination of the contract at no cost to the consumer, and with it, the return by BM of the sums paid by the consumer and user, without retention of expenses, except for cases in which the consumer has expressly selected a delivery method other than the least expensive method of ordinary delivery, in which case BM will not be obliged to reimburse the additional costs arising therefrom. The reimbursement of these sums will be carried out without undue delay and, in any case, before 14 calendar days have elapsed from the date on which BM has been informed of the decision to withdraw from the contract by the consumer and user. The exercise of the right of withdrawal entails the obligation of the consumer to return the product to BM, in the same conditions in which he/she received it, at the latest within 14 calendar days from the date on which he/she communicates his/her decision to withdraw from the contract. Therefore, BM may withhold the refund until it has received the goods or until the consumer has provided proof of the return of the goods. In order to exercise the right of withdrawal, the product must be returned in the same condition in which it was received, so no refund will be made in those cases where the product is in different conditions or has suffered any deterioration, impairment or damage. The refund will be made by the same means of payment with which it was initially paid, unless the consumer has expressly provided otherwise, and provided that the consumer does not incur any expense as a result of the refund.
